Executive Body Proposes New Regulations to Law on Compulsory Enforcement of Judicial Acts

According to the current regulations, only the compulsory enforcement officer carrying out the proceedings has the authority to make decisions and perform enforcement actions within the framework of proceedings. Implementation of enforcement actions by other enforcement officers is possible only in case of forming a group of enforcement officers or transferring the enforcement proceedings to another enforcement officer.

The draft proposes to establish the possibility of a separate enforcement action by another enforcement officer within the framework of enforcement proceedings. The possibility of carrying out separate support actions by another structural subdivision of the enforcement service or another employee will be established, for example, distribution of confiscated money by the employees of the financial department. The next amendment will establish the regulations on combining several enforcement proceedings that are interrelated or have fully or partially overlapping members of enforcement proceedings into one proceeding or on separating the proceedings with separate requirements from one enforcement proceeding.

The addenda proposed by the Government to the Law on Compulsory Enforcement of Judicial Acts were debated at the sitting of the NA Standing Committee on State and Legal Affairs on September 28. The RA Deputy Minister of Justice Grigor Minasyan presented the issue.

The Committee Chair Vladimir Vardanyan highlighted the amendments, noting that additional resources are needed in terms of equally distributing the workload of the Judicial Acts Compulsory Enforcement Service. “We cannot keep expanding the number of employees of the compulsory enforcement service,” he said.

According to the next legislative regulation, the executive body proposes amendments and addenda to the Law on Compulsory Enforcement of Judicial Acts.

The RA Deputy Minister of Justice Grigor Minasyan noted that the law now sets out only general provisions related to the confiscation of property within the framework of enforcement proceedings.

As a result of the debates, the Committee endorsed the debated bills.
